If you’ve had a planning application refused Roseland Planning can provide a fresh perspective and get back to the drawing board. With the right perspective and advice matters for refusal can often be overcome through negotiation and through subsequently making some changes to the proposal. You are entitled to a ‘free go’ re-submission within 6 months of the refusal so almost certainly don’t give up.
We will review the council’s reasons for refusal contained within the Decision Notice and Officer’s Report and advise on the best course of action. This could involve making some changes, for example around design or identifying some measures to mitigate the development’s impact or including additional information and reports. Whatever the reasons for refusal, we can work to devise creative and innovative solutions that can overcome problems and planning objections.
Alternatively, you can appeal against the refusal of planning permission. An appeal is lodged with the Planning Inspectorate, an independent body from the Local planning Authority, and the appointed Inspector will adjudicate on the matter and provide a written decision to consultee responses and representations can be made.
An appeal submission is similar to a planning application and it’s important the documents submitted put forward the best possible arguments as to why your proposal should in fact be allowed. If you’ve received an enforcement letter or notice, firstly don’t panic and secondly don’t ignore it! But it is important to act quite quickly. Enforcement action can often be worked through amicably and in positive dialogue with the local council if approached with transparency and pragmatism.
