There has been recent media publicity in what is being branded as (Jeremy) ‘Clarkson’s Clause’ which saw recent changes in legislation associated to permitted development rights around the conversion of Agricultural Buildings into either Residential property/properties, or Commercial use and ventures, i.e. development which can be done without planning permission.
Whilst the spirit of this movement is great in principle, as ever the devil is in the detail and there are various fairly complex criteria which must be applied to qualify under permitted development and it is always advisable to seek professional planning advice before embarking on a new diversification adventure . Even where permitted development does apply , whilst a formal planning application is not required there is a need to submit ‘Prior Approval’. There are different types of prior approval, which require various levels of detail before a Council will assess a proposal. Depending on what you are seeking prior approval for, you could be required to submit information on a wide variety of aspects of the proposal, including the justification for the development, the design and external appearance, the transport impacts of the development and flooding information.
